Terms & Conditions of Service


Welcome to the website for Urban Oyster, LLC doing business as WeVenture (“WeVenture,” “the Company,” “we,” “us,” or “our”). The following Terms and Conditions of Service govern your use of this website. If you visit or shop at We-Venture.com, you accept these conditions, so please read them carefully.  We may make changes to the website, and therefore these terms and conditions may change over time without any advance notice to you.  We encourage you to review the site and the terms and conditions periodically for any updates or changes.  Your continued access to or use of the site shall be acceptance by you of these changes and the reasonableness of these standards for notice of the changes.  We try to make WeVenture.com available 24 hours a day, 7 days a week for your convenience, but some technological complications may be encountered from time to time.


Prior to confirming your tour with WeVenture, kindly review and understand the applicable terms and conditions associated with your booking. By booking, registering for, making a payment towards, or participating in a tour with WeVenture, you (“you”, “participants”, “customers” or “guests”) agree to the Terms and Conditions in effect at the time of your booking. These Terms represent a legally binding contract. 

  • About WeVenture Website


1.1 The Website is owned and managed by WeVenture.


1.2 We can be contacted by email at [email protected] or via the “Contact Us” section of the website.


1.3 By using the Website, you warrant that:


1.3.1 you are legally capable of entering into binding contracts;


1.3.2 you are not in any way prohibited by the applicable law in the jurisdiction in which you are currently located to enter into these Terms; and


1.3.3 you are at least 18 years old. If you are under the age of 18, you must ask a parent or guardian over the age of 18 to enter into these Terms on your behalf. As a parent or guardian of someone under the age of 18, you are responsible for ensuring that person’s use of the service at all times is in accordance with these Terms.


1.3.4 If you make a booking for anyone other than yourself, you are considered the designated contact person for those other travelers. You represent and warrant that you are legally authorized to act on their behalf; that you have obtained all required consents; and that you will inform them of these Terms and warrant that they accept and agree to them. You are also responsible for making all payments due for your booking; notifying us if any changes or cancellations are desired; and keeping the other travelers informed of all information relevant to your trip.


1.3.5 You will not:

  1. use any robot, spider, scraper or other automated means to access the Service for any commercial purpose without express written permission of WeVenture or its licensors;
  1.  take any action that imposes, or may impose in WeVenture’s sole discretion, an unreasonable or disproportionately large load on our infrastructure;


  1.  interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; 


  1. bypass any measures WeVenture may use to prevent or restrict access to the Service. WeVenture retains the right at its sole discretion to deny access to anyone to this Service, at any time and for any reason, including, but not limited to, for violation of these Terms of Service; or


  1.  resell or commercially use this website or its contents; 


  1.  download or copy any account information for the benefit of another merchant or other person or entity; 


  1.  use any false or inaccurate information for purposes of establishing an account with us;


  1.  provide any information or take any other action with the purpose of establishing an account with us in order to place test orders; 


  1.  delete or revise any material or other information of ours or any other user; 


  1.  harvest or otherwise collect information about others, including e-mail addresses, without their consent; 


  1.  collect or otherwise use any data located on the website for litigation or legislative purposes; 


  1.  take any action that imposes an unreasonable or disproportionately large load on the website’s infrastructure; 


  1.  use any device, software or routine to interfere or attempt to interfere with the proper working of the website or any activity being conducted on this website; 


  1.  use any engine, software, tool, agent or other mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the website other than (i) the search engine and search agents available from WeVenture and (ii) generally available third party web browsers 


  1.  allow any other person or entity to use your Customer Number or other identifying information; or


  1. attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Service;

1.3.6 You further agree not to violate or attempt to violate the security of the website, including, without limitation, actions such as:

  1.  accessing data not intended for you or logging into a server or account that you are not authorized to access;


  1.  attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; 


  1.  attempting to interfere with service to any user, host or network, including, without limitation, by way of submitting a virus to or overloading, using any type of spyware or redirecting software, “flooding,” “spamming,” “mailbombing” or “crashing” the website; 


  1.  forcing the placement of cookies; 


  1.  sending unsolicited e-mail, including promotions and/or advertising of products or services; or 


  1.  forging any TCP/IP packet header or any part of the header information in any e-mail or posting. 

  • Bookings & Payment


2.1 To secure a reservation, customers must make full payment or a specified deposit on certain day tours, custom or multi-day tours.


2.1.1 Day tours (Public and Private) require full payment at the moment of booking.


2.1.2 Custom tours may have different payment requirements and your booking agent will inform you once the details for your tour have been created, via email.  


2.1.3 Multi-Day tours require a $500 per person deposit to secure your spot. The balance is then due 60 days prior to your trip start date. Final acceptance of any participant is subject to receipt and review of all required forms, documents, and payment. In the event that your trip start date is less than 60 days from the date of your booking, full payment is due at the time of booking.


2.2 Day (Public and Private) and custom tours booking confirmations will be sent via email.


2.3 Multi-Day booking confirmations will be sent via email, including relevant details such as itinerary, accommodations and transportation.


2.4 Payment shall be made in United States of America currency.  Any fees or charges related to conversion from local currency are your responsibility. 

  • Cancellations & Refunds


3.1 Cancellations made by you are subject to the cancellation Terms set out below. A cancellation will only be effective when we receive written confirmation from you that you wish to cancel via email to [email protected]. If booking is made thru a third party distributor please refer to their Terms and Conditions for additional cancellation policies. 


3.1.1 Day Public Tours require a 24 hour advance notice cancellation before your tour start time. 


3.1.1.a A full refund will be issued if you have provided 24 hour advance notice. 

3.1.1.b If you cancel your tour within less than 24 hours no refund will be issued. 


3.1.1.c No-shows will not be refunded.


3.1.2 Day Private Tours require a 48 hour advance notice cancellation before your tour start time. 


3.1.2.a A full refund will be issued if you have provided 48 hour advance notice. 


3.1.2.b If you cancel your tour within less than 48 hours no refund will be issued. 


3.1.2.c No-shows will not be refunded.

3.1.3 Custom Tours will require a ______ notice cancellation before the start time of your tour. 


3.1.3.a A full refund will be issued if you have provided        hours advance notice.

3.1.3.b If you cancel your tour within less than _____ a partial refund may be issued, equal to the full amount minus administrative fee charges . 


3.1.3.c  If you cancel your tour within less than _____ no refund will be issued. 


3.1.3.d No-shows will not be refunded.


3.1.4 Multi-Day cancellation policy.


3.1.4.a If you cancel more than 60 days prior to the trip start date, we will grant you a full refund minus a $100 per person for administrative fee*.


3.1.4.b If you cancel between 59 and 30 days prior to the trip start date, we will retain 50% of the trip cost.


3.1.4.c If you cancel less than 30 days prior to the trip start date, or once the trip has begun, there will be no refund issued.

3.2 WeVenture reserves the right to cancel tours at any time.


3.2.1 We reserve the right to cancel tours when unforeseen circumstances arise, unsafe conditions, Force Majeure Event, or any other reason. 


3.2.1.a FORCE MAJEURE EVENT: Certain unexpected circumstances may arise, such as (but not limited to) weather events, pandemics, quarantines, border closures, acts of governments or authorities, wars, hostilities, political uprisings or civil disturbances, riots, strikes, terrorist activities or the threat of terrorist activities, criminal acts committed by third parties, defects of vehicles or breakdown in equipment, labor disputes, or an Act of God, that are beyond anyone’s control, which force a cancellation or disruption of services. These circumstances are considered a force majeure. We will not be held responsible or liable in any way for such events, including death, bodily injury, illness, damage, delay, or other losses caused by such events. While we will always strive to assist you when such circumstances occur, any losses or costs resulting from these events will be your responsibility.


3.2.2 In the event WeVenture makes the cancellation of the tour, you will receive a full refund.


3.2.3 WeVenture is not responsible for additional expenses incurred by preparing for the tour or trip (for example: non-refundable advance purchase air tickets, clothing, equipment, visa fees, medical expenses, etc.).


3.3 Understand that if you book your tour through a third party distributor, it may have  additional or different cancellation terms.  Our terms and conditions, including without limitation, our cancellation policy, apply even if you have booked your tour through a distributor.  

  • Right to Distribute Media


4.1 By participating in any tour provided by WeVenture, you agree to comply with the following terms and conditions related to the right to distribute media:


4.1.1 Grant of License:


4.1.1.a Media Release: Participants grant WeVenture the irrevocable and unrestricted right to use, reproduce, and distribute any photographs, videos, or other media captured (the “Media”) during any of our tours for promotional, marketing, and educational purposes.


4.1.1.b Scope of License: This license includes but is not limited to the right to distribute the Media on the Company’s website, social media channels, promotional materials, and any other platforms deemed appropriate by the Company.


4.1.2 Participant Obligations:


4.1.2.a Consent: By booking any of our tours, you confirm that you have obtained the consent of all individuals in your booking for the Company to use, reproduce, and distribute to their likenesses.


4.1.2.b Release of Claims: Participants release the Company from any claims, demands, or causes of action arising out of the use of the Media, including but not limited to claims for defamation, invasion of privacy, or infringement of publicity rights.


4.1.3 Restrictions:


4.1.3.a No Compensation: Participants acknowledge that they will not receive any compensation, monetary or otherwise, for the use of the Media by the Company.


4.1.3.b Commercial Use: The Company retains the right to use the Media for all purposes, including but not limited to, commercial, advertising and promotional activities.


4.1.4 Duration of License: The license granted to the Company is perpetual and worldwide, meaning that the Company has the right to use the Media indefinitely and in any geographical location.


4.2 WeVenture strives to make your experience a pleasant one. If you don’t feel comfortable with photographs, videos, or other media to be captured in your tour, please reach out to us in an email or within the comment section in your booking and inform us in advance. You can also inform your guide before the tour starts. We exercise reasonable care in accommodating your request.

  • Itinerary Changes


5.1 WeVenture reserves the right to change itineraries before or after the tour has begun if circumstances warrant. 


5.2 In the absence of our own gross negligence, we shall not be responsible for any cancellations, delays, diversions or substitution of transportation, equipment; loss or damage to baggage or property; injury, illness, or death; or any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the any act, omission, error or negligence whatsoever by third parties. 

  • Inclusions


6.1 WeVenture reserves the rights to change or adjust inclusion in any of the tours provided that may include but not limited to the following: food, beverages, third party activity tickets, etc.


6.2 WeVenture is not responsible for any Terms and Conditions that a third party distributor may have when you book using their website.  WeVenture and third party distributors operate independently, and you agree that nothing in these Terms of Service shall be interpreted to create an association, joint venture, agency relationship, or partnership between WeVenture and third party distributors.


6.3 WeVenture is not responsible for communication failures, errors, difficulties, or other malfunctions, nor is it responsible for any lost, stolen, or misdirected transactions, transmissions, messages, or entries on or in connection with the Service. The Service may not be continuously available due to (i) maintenance or repairs, (ii) computer problems, (iii) disruptions in Internet service, or (iv) other unforeseen circumstances.

  • Liability & Insurance


7.1 Liability Waiver: Participants acknowledge and accept the inherent risks associated with outdoor activities and agree to release WeVenture from liability for personal injuries, accidents, or property damage incurred during the tour.  You may be required to sign a waiver or other paperwork prior to the commencement of a tour.


7.2 Insurance: We recommend participants obtain appropriate travel insurance covering cancellations, medical emergencies, and other potential risks before embarking on the tour.


  1. Limitation of Liability:

7.3.1 WeVenture does not assume any responsibility for and is not liable for any damages to computers, equipment or other property of you or the person making use of the Service caused by or arising from their access to, use of, or browsing of the Service, or their downloading of any information or materials from this Service.

7.3.2 In no event will WeVenture, or any of its officers, directors, employees, shareholders, affiliates, agents, successors or assigns be liable to you, the person making use of the Service, or anyone else for any indirect, punitive, or consequential damages (including but not limited to those damages resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of using the Service (or the materials, information or other content contained on the Service) whether on the basis of contract or on any other legal basis.

7.3.3 In the event of any problem with the Service, you or the person making use of the Service agrees that their sole remedy is to cease using the Service.

7.3.4 In no event shall WeVenture’s total liability to you or the person making use of the Service (whether based on contract or tort or otherwise) exceed in the aggregate the greater of (a) the booking fee, or (b) one hundred US Dollars ($100).

7.3.6 Nothing in these Terms of Service shall limit or exclude WeVenture’s liability solely to the extent that such liability cannot be excluded or limited by applicable law.

  • Health & Safety


8.1 The participant is responsible for assessing their physical fitness level and ensuring it aligns with the tour requirements. 


8.2 The participant is responsible to inform us prior to the start time of the tour, any health conditions or limitations that may affect the completion of the tour. 


8.3 The participant is responsible to inform us of any food allergy, other kinds of allergies or dietary restrictions prior to the start time of your tour.  It is the responsibility of the participant to determine in advance if the tour, or any inclusions, pose a risk of allergic reaction by the participant.


8.4 Should any medical emergency arise which precludes your ability to consent to emergency treatment when such authorization is required, we or our representatives will endeavor to communicate with your travel companions or previously designated emergency contact to request permission for any necessary treatment. If our representatives believe, in their sole discretion, that time or circumstances do not permit such communication, you authorize our representatives to consent on your behalf to any medical treatment, including all types of medical examinations, diagnoses, medication, treatment, or physician or hospital care, that is deemed advisable by, and is to be rendered under, the supervision of any physician or surgeon at your cost and expense. You agree not to hold us or our representatives responsible for actions relating to any such medical or emergency treatment.

  • Participation and Conduct


9.1 Participant Responsibility: 


9.1.1 Participants are expected to adhere to safety guidelines and instructions provided by tour guides.


9.1.2 Participants are expected to have respectful behavior towards fellow participants, guides, and local cultures.


9.2 WeVenture reserves the right to remove a specific traveler prior to departure or during the tour, at our own discretion if any of the Terms & Conditions, including but not limited to these conduct provisions, are not followed.  


  1. Intellectual Property Rights

10.1 WeVenture grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service and the content made available through the Service solely for the purposes for which it is being made available. This license does not include any collection and/or use of any images or third-party content on the Service; any derivative use of the Service or its contents; any downloading or copying of customer or account information for the benefit of a third-party; or any use of data mining, robots, scraping or similar data gathering and extraction tools. Except as expressly permitted by these Terms of Service, the Service, or any portion thereof, may not be reproduced, sold, resold, visited or otherwise exploited for any commercial purpose without WeVenture’s express written consent.

10.2 Unless otherwise noted, all of the content featured or displayed on the Service, including without limitation, text, graphics, photographs, images, sound, and illustrations (“Content”), is owned by WeVenture, its licensors, vendors, agents or Providers. All elements of the Service, including without limitation the general design and the Content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. The Service may only be used for the intended purpose for which such Service is being made available. You may not modify any of the materials nor copy, distribute, transmit, display, perform, reproduce, adapt, publish, license, create derivative works from, transfer or sell any information or work contained on the Service. The Service, its Content and all related rights shall remain the exclusive property of WeVenture or its licensors unless otherwise expressly agreed. You will not remove any copyright, trademark or other proprietary notices from material found on the Service.

10.3 All trademarks, service marks and trade names of WeVenture used in the Service (including but not limited to: WeVenture’s name and logo; the Service’s name, design, and any logos) (collectively “Marks”) are trademarks of WeVenture or its affiliates, partners, vendors or licensors. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify the Marks in any way, including in advertising or publicity pertaining to distribution of materials on the Service, without WeVenture’s prior written consent. WeVenture prohibits the use of the Marks as a “hot” link on or to any other website unless establishment of such a link is approved in advance in advance by WeVenture. You shall not use WeVenture’s name or any language, pictures or symbols which could, in WeVenture’s judgment, imply WeVenture’s endorsement in any written or oral advertising, presentation, brochure, newsletter, book, or other written material of whatever nature, without prior written consent.

10.4 From time to time, the Service may contain links to external websites that are not owned, operated, or controlled by WeVenture or its affiliates. All such links are provided solely as a convenience to you or the person making use of the Service. Neither WeVenture nor any of its respective affiliates are responsible for any content, materials or other information located on or accessible from any other websites. WeVenture and its affiliates do not endorse, guarantee, or make any representations or warranties regarding any other websites, services, or any other information located or accessible from any other websites or services. If you or the person making use of the Service decide to access any other websites, this person does so entirely at their own risk.

  • Electronic Communication


When you visit WeVenture.com or send e-mails to us, you are communicating with us electronically and are consenting to receive communications from us electronically regarding a purchase or response to a question or comment or because you have chosen to receive promotional, legal or reminder emails about your contact lenses. We will communicate with you by e-mail or by posting notices on this website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

  • Reselling Products Prohibited


You are absolutely prohibited from reselling in any manner any products you purchase from WeVenture, whether you purchased the products through the website or by any other means. 

  • Your Account


If you use this website, you are responsible for maintaining the confidentiality of your account, password, Customer Number and other related login and account information and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree to immediately notify us of any unauthorized use of your Customer Number or account or any other breach of security. In consideration of your use of this website, you agree to (a) provide true, accurate, current and complete information about yourself as prompted by the forms for your account, prescription and order information (the “Account Information”) and (b) maintain and promptly update the Account Information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse any and all current and future use of this website. Account Information and certain other information about you are also subject to our Privacy Policy. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
